Blue Sky Law Fights for Teacher in Whistleblower Lawsuit Against Henry County Schools
Blue Sky Law is proud of Attorney Barton Black, who continues to tenaciously advocate for his client! For over four years, Attorney Black has been respresenting Sheri Mimbs, a former Henry County Schools teacher who contends that she was terminated for refusing to raise her students’ grades at the behest of her Principal and Assistant Principal. Ms. Mimbs is currently awaiting her day in court to present her case to a jury.
This case has garnered media attention, and just last week, Ms. Mimbs and Attorney Black were interviewed by WSB-TV to bring attention to Ms. Mimbs’ battle. Thank you to WSB-TV for the great coverage. Click HERE to read the entire article.
Ms. Mimbs’ case has taken many twists and turns. Two years ago the Henry County Superior Court dismissed Ms. Mimbs’ case, stating that Ms. Mimbs had filed her lawsuit too late — outside of the statute of limitations for Georgia Whistleblower Act claims. Not taking this lying down, Ms. Mimbs appealed this decision, first, to the Georgia Court of Appeals, and, second, to the Supreme Court of Georgia, to reverse the decision of the superior court.
On February 17th, 2022, Attorney Black brilliantly presented, for his client, an oral argument in front of the Supreme Court of Georgia. In the oral argument, attorneys representing each side in a dispute have 20 minutes each to make their case and answer thought-provoking questions from the justices on the Supreme Court of Georgia.
Blue Sky Law is proud that on May 3, 2022, in a unanimous decision, the Supreme Court of Georgia reversed the Henry County Superior Court and held that Ms. Mimbs’ claim for retaliatory termination was properly filed within the Georgia Whistleblower Act’s 1-year statute of limitations. The Blue Sky Law client is now able to pursue her claim before a jury trial.
According to Barton Black, “We were excited for Ms. Mimbs that the Supreme Court ruled in her favor. Ms. Mimbs stood up to her principal, and we were going to stand up for her until she got her day in court.”
